F-1 Duration of Status Rule Postponed: What Students Should Do

A Sept. 14 court order postponed the F-1/J-1 duration-of-status rule nationwide. What it means for OPT, travel and status, and when to request a review.

The direct answer

Did duration of status end on September 15?

No. A September 14, 2026 federal-court order postponed the fixed-admission rule nationwide. It did not take effect on September 15. This is temporary relief while litigation continues, not permanent cancellation.

Correction to our earlier deadline guidance

Updated September 15, 2026: Our earlier article described the scheduled September 15 implementation. The September 14 court order supersedes that guidance. The fixed-admission, transition-date, and shortened-departure-period instructions previously described here should not be treated as current requirements under this postponed rule.

What did the court order?

In Presidents’ Alliance on Higher Education and Immigration v. DHS, No. 26-13799-FDS, the District of Massachusetts postponed the rule’s effective date under 5 U.S.C. § 705. The order covers the rule nationwide, including its F, J, and I provisions. It does not finally invalidate the rule.

What about Forms I-539 and I-765?

AILA reports that the new I-539 and I-765 editions will no longer take effect on September 15 because of the injunction. We could not retrieve direct USCIS confirmation on September 15. Check USCIS’s current form instructions immediately before filing; do not rely on our earlier no-grace-period warning.

This student-rule order should not be treated as postponing unrelated immigration rules or filing deadlines.

Frequently asked questions

Quick answers

Did D/S end on September 15, 2026?

No. The court postponed the rule nationwide. This is temporary relief, not a final cancellation.

Must every student file an extension because September 15 arrived?

No. The postponed rule does not create that filing requirement. Existing status, school, employment, and individual filing obligations still need review.

Can I travel, apply for OPT, transfer schools, or move to H-1B?

The answer depends on your documents and circumstances. Have your I-94, I-20 or DS-2019, EAD, travel plans, and relevant notices reviewed before taking action.
