The Law Offices of Pejman Behkar, APC practices immigration law in Beverly Hills and serves clients in the Los Angeles area. Our practice includes family-based green cards, I-601A provisional waivers, removal defense, BIA appeals, and Ninth Circuit petitions for review.

We offer communication in English, Spanish, and Farsi so you can explain your concerns and understand the next steps.

Immigration Help Built Around Your Situation

Immigration cases often involve more than one form. A family petition may raise questions about unlawful presence. A green card plan may need to account for immigration court proceedings. A prior denial may call for a review of the evidence and the decision.

Our approach begins with the facts: your entries and departures, family relationships, applications, notices, and any criminal or court history. From there, we can discuss possible paths, important deadlines, and issues that need further review.

You do not need to know the name of the application before contacting the firm. Start with what happened and what you hope to accomplish.

Family-Based Green Cards

Family immigration can help eligible relatives seek permanent residence. The process depends on the relationship, the petitioner’s status, visa availability, and the applicant’s immigration history.

Marriage and Other Family Petitions

A family petition establishes a qualifying relationship. It does not automatically grant a green card or protect someone from removal.

Marriage cases require evidence that the relationship is real. Other family categories have their own requirements. We review the documents needed to establish the relationship and identify issues that may affect the next stage.

Bring marriage certificates, birth certificates, prior divorce records, and immigration notices when available. Missing documents can be discussed during the consultation.

Adjustment of Status or Consular Processing

Some people qualify to apply for a green card inside the United States through adjustment of status. Others must complete immigrant visa processing at a U.S. consulate abroad.

The right process depends on your facts. Entry without inspection, prior departures, removal orders, and other concerns can affect the analysis. Before making travel plans, review whether leaving could trigger a bar to returning.

Before filing, check the current USCIS Form I-130 instructions, Form I-485 instructions, and government fee schedule. Where a visa limit applies, review the Department of State Visa Bulletin and the USCIS filing chart for that month. Eligibility alone does not guarantee discretionary approval; current policies and the individual record also matter.

I-601A Provisional Unlawful Presence Waivers

An I-601A waiver may allow certain immigrant visa applicants to request a provisional waiver of the three-year or ten-year unlawful presence bar before leaving the United States.

The application requires extreme hardship to a qualifying U.S. citizen or lawful permanent resident spouse or parent. A child alone cannot serve as the qualifying relative for this waiver.

Approval does not provide lawful status, employment authorization, protection from removal, or a guaranteed visa. Other grounds of inadmissibility must be reviewed separately.

Learn about eligibility, hardship evidence, and the consular interview on our I-601A waiver page.

Removal Defense and Immigration Court

If you receive a Notice to Appear or face ICE detention, the first priority is to understand your case status and deadlines. Immigration court proceedings can involve questions about the government’s charges and whether you qualify for relief.

Possible options may include asylum, cancellation of removal, adjustment of status, or certain waivers. Each has specific requirements. Bond review may be available in some detention cases.

An approved family petition does not automatically stop a court case. Keep attending required hearings unless the court excuses you, and follow the court’s address-change requirements.

Bond eligibility and available defenses depend on the applicable law, the person’s history, and any controlling court orders. Confirm hearing information using court notices and EOIR’s case information system. Online information does not replace official notices. Contact changes generally must be reported to the immigration court on Form EOIR-33/IC within five working days.

Visit our removal defense page for more information about hearings, detention, and possible defenses.

BIA Appeals, Motions, and Federal Court Review

A denial or removal order does not always end the legal analysis. Depending on the decision and your circumstances, an appeal or motion may be available.

Appeals to the Board of Immigration Appeals

The BIA reviews certain immigration judge decisions. An appeal should identify supported errors and follow the required filing procedures. It is generally not a new hearing for adding evidence.

Have the decision reviewed promptly. Waiting for other applications or documents can create deadline problems.

Motions to Reopen or Reconsider

A motion to reopen generally relies on new facts supported by evidence. A motion to reconsider addresses claimed errors in a decision. Time and number limits often apply, with exceptions in certain cases.

Filing a motion does not always stop removal. The available options depend on the order, the record, and the applicable rules.

Ninth Circuit Petitions for Review

A Ninth Circuit petition for review may be available after a final agency decision in an appropriate case. Federal court review has limits, and filing a petition does not automatically stop removal.

Have the decision and its service date reviewed immediately. Check EOIR’s appeal instructions, the current motion rules, and the Ninth Circuit’s immigration resources for the applicable procedure. The deadline, fee or fee-waiver requirements, and any need for a separate stay request must be evaluated for the specific case.
