Refugee Termination Notices: New 10-Day Response Rule

USCIS refugee termination notices now carry a shorter response period. A rule effective October 14, 2026, reduces the period under 8 CFR 207.9 from 30 days to 10 days from service. Mailing and deadline-calculation rules still apply.

This change concerns people receiving notices proposing to terminate refugee status because USCIS believes they did not meet the refugee definition when admitted. It does not automatically terminate every refugee's status or set the deadline for every asylum or immigration notice.

Key dates

The rule was published and became effective October 14, 2026. Public comments are due November 13, 2026; that comment period does not postpone an individual's response deadline.

When does the response clock start?

Service controls. For mailed notices, service is complete upon mailing and three days are added. Calendar days count, with an adjustment when the last day falls on a weekend or federal holiday. An attorney should calculate the deadline from the actual record.

Must I submit all evidence immediately?

The rule also permits a timely request to provide oral evidence. Counsel should review the notice, allegations and available response options promptly.

What should I bring to a consultation?

Bring every page of the notice, its envelope, tracking information, prior immigration records and any stated deadline. Ask the firm for secure document delivery.
