Can I Keep Working While My EAD Renewal Is Pending? October 2026 Update

A pending EAD renewal does not always extend work authorization. Understand the October 2026 rule, earlier-filing exceptions, and what to review.

The direct answer

Does filing an EAD renewal automatically let me keep working?

Not necessarily. For covered renewals filed on or after October 30, 2025, filing alone does not provide the former automatic extension. Earlier qualifying filings and other legal exceptions require separate review.

What happened on October 14, 2026?

DHS finalized its October 2025 rule without changing the regulations. Today’s publication does not cancel everyone’s existing work authorization.

Which situations need a closer look?

  • A qualifying renewal properly filed before October 30, 2025 may retain an extension of up to 540 days, subject to all eligibility conditions.
  • Certain TPS notices or other laws may separately extend authorization.
  • People authorized to work through their immigration status may have different documentation rules.

Prepare these records before asking whether you can work

Start with your own documents. A friend’s experience or a social-media headline cannot establish the dates and category in your case.

  • Your current EAD, front and back.
  • The I-765 receipt notice and any later USCIS decision.
  • Your I-94 and relevant status or approval notices, if applicable.
  • The date your employer needs updated documents.

Ask counsel to identify the precise basis for continued work authorization and the evidence supporting it. Avoid posting these documents publicly. Contact the office before the card expires when possible, so there is time to discuss your situation.

Resumen en español

Una renovación pendiente no siempre permite seguir trabajando. La fecha de presentación, la categoría del permiso y las excepciones aplicables deben revisarse. No suponga que una regla sobre el permiso de trabajo también autoriza viajar.
