The direct answer
Does advance parole protect an asylum case when you return to the country you fear?
Advance parole does not eliminate the abandonment rule. Under 8 C.F.R. § 1208.8(b), a return to the country of claimed persecution creates a presumption of abandonment unless compelling reasons are established. In Matter of M-R-I-, the BIA applied that rule to asylum, withholding of removal and CAT protection.
What the BIA decided on October 7
In Matter of M-R-I-, 30 I&N Dec. 137 (BIA 2026), the Board held that a respondent who returned under advance parole to the country of claimed persecution had abandoned his protection application because he did not establish compelling reasons for returning.
The ruling concerns return to the country identified in the protection claim. It does not mean that every international trip automatically abandons every protection application. Other travel consequences and controlling federal-court authority still require individual review.
Why the travel explanation mattered
The respondent traveled to Nepal for about two months in 2016. He cited missing his family, concerns about his mother's health and the family's welfare following the 2015 earthquake. In 2018, he met relatives in India.
The Board agreed that the delay between the cited events and the Nepal trip, together with the demonstrated alternative of meeting family elsewhere, undermined the claim of compelling reasons. The decision does not supply an exhaustive list of circumstances that qualify.
Why advance parole is not enough
Advance parole allows a traveler to seek parole on return; it does not guarantee admission or preserve a pending protection case against every travel consequence.
The BIA treated abandonment as applying to the respondent's entire application, including asylum, statutory withholding and CAT protection. An applicant should not assume that the CAT portion necessarily survives a return trip that triggers this rule.
What to review before travel
Discuss the proposed destination, timing, reason, length of stay and alternatives with counsel before making travel plans. Preserve evidence supporting any emergency or other claimed compelling reason.
- Travel document, I-94 and filing receipts.
- Prior applications, statements and court orders.
- Proposed itinerary and evidence of the reason for travel.
- Records of previous trips and any later developments.
If the trip has already occurred, obtain advice based on the full record. No result is automatic or guaranteed. Keep private case documents out of public comments and social-media messages.

Frequently asked questions
Quick answers
Does advance parole guarantee that my asylum case stays pending?
No. It does not remove the presumed-abandonment rule for a return to the country of claimed persecution and does not guarantee admission or a favorable decision.
What counts as a compelling reason?
The BIA did not provide an exhaustive definition. The explanation, timing, supporting evidence and alternatives must be evaluated in the individual record.
Does this decision reach withholding and CAT protection?
Yes. The BIA applied the rule to the respondent's entire protection application. Case-specific procedural issues and controlling federal-court authority still require review.
